THE JUDICIARY

The Judicial Power is composed by:

•  Attorney General's Office (Procuradoria Geral da República)

•  The Constitutional Court (Tribunal Constitucional)

•  The High Council of the Judicial Power (Conselho Superior da Magistratura Judicial)

•  The Courts (Tribunais)

The Attorney General's Office (Procuradoria Geral da República)

The Attorney General's Office is represented in the courts by the Ministry of Justice and is presided over by the Attorney General. The Attorney General's Office defends democratic legality and represents the State in taking penal action and defending the interests assigned to it by law.

The Constitutional Court (Tribunal Constitucional)

The Constitutional Court is in charge of administering justice on legal and constitutional matters. It is responsible for considering whether laws, ratified international treaties and any rules are unconstitutional, as well as considering appeals in respect of all decisions of other courts which have been evoked during the trial because of its constitutional nature.

The High Council of the Judicial Power (Conselho Superior da Magistratura Judicial)

The High Council of the Judicial Power is presided over by the President of the Supreme Court and is composed by 3 lawyers nominated by the President of the Republic, 5 lawyers nominated by the National Assembly and 10 judges elected by judicial judges. The High Council is responsible for proposing the appointment of judges to the Supreme Court, appointing, placing, transferring and promoting judges, as well as considering the professional ability of judges and taking disciplinary action when necessary.

The Courts (Tribunais)

Courts are sovereign bodies provided with powers to administer justice and discharge jurisdictional duties. They shall guarantee and ensure compliance with the laws and the protection of rights. Apart from the Constitutional Court , courts shall be structured as follows:

•  Municipal Courts

•  Provincial Courts

•  The Supreme Court
